Privacy Policy
This is the Privacy Policy of Proximity LLC a/k/a Proximity Music, which applies to the website located at prxmusic.com and any related pages that link to this Privacy Policy (collectively, the "Services").
Proximity LLC and its affiliates ("PRX," "we," "us," or "our") are committed to protecting your privacy and being transparent about how we collect and use information.
By using the Services, you agree to the practices described in this Privacy Policy. If you do not agree, please do not use the Services. We may update this Privacy Policy from time to time; when we do, we will revise the "Last Updated" date above.
Information we collect
We collect two types of information: personal information ("Personal Information") and information that does not identify you ("Non-Personal Information").
Personal Information
We may collect the following categories of Personal Information when you interact with the Services:
- Contact information: Name, email address, and any other information you choose to include when you contact us (for example, via a contact form or email).
- Demo submission information: If you submit a demo through our Demo Submission form, we collect your Artist Name, email address, a link to your track, and a short description you provide. This information is used solely for A&R (artist and repertoire) evaluation purposes. See Section 06 for more detail.
- Newsletter / mailing list information: If you sign up for our mailing list or newsletter (now or in the future), we collect your email address and any name you provide at signup.
- Account details (if applicable): Username and basic profile information if we ever offer account registration or fan/community access.
- Technical identifiers: IP address and basic device information that is automatically provided by your browser or device when you access the Services.
- Career/press information: Information you provide if you contact us about career opportunities, internships, press, or collaboration.
We do not intentionally collect sensitive categories of Personal Information (such as government IDs, health information, or precise geolocation) through the Services.
Non-Personal Information
We may collect or generate Non-Personal Information such as generalized statistics about website usage that do not identify you personally. We may use or share such information for any purpose allowed by law.
How we use information
We use Personal Information for limited, straightforward purposes, including:
- To operate, maintain, and provide the Services.
- To respond to your messages, inquiries, and requests (for example, booking, business, press, or demo inquiries).
- To evaluate demo submissions for potential A&R consideration.
- To send newsletters or marketing communications to people who have opted in (see Section 07).
- To protect the security and integrity of the Services and to prevent fraud or abuse.
- To comply with legal obligations and enforce our terms and policies.
We may use Non-Personal Information in aggregated or de-identified form to understand how people interact with the Services and to support basic internal reporting.
We do not use your Personal Information for behavioral advertising, retargeting, or any adtech-driven profiling.
Tracking technologies
We do not use cookies, analytics scripts, advertising pixels, or any behavioral tracking technologies on the Services. We do not engage in cross-site tracking, interest-based advertising, or any form of adtech-driven data collection. What you do on this site is not tracked, profiled, or sold.
If this ever changes (for example, if we later implement analytics or features that rely on cookies), we will update this Privacy Policy and, if required, provide appropriate notice or obtain consent where the law requires it.
Because we do not use cookies or other non-essential trackers, we do not currently need or display a cookie consent banner.
Your privacy rights
California Residents — CCPA / CPRA
If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA):
- Right to Know: You have the right to request that we disclose what Personal Information we have collected about you, the categories of sources, the purposes for collection, and any third parties with whom we share it.
- Right to Delete: You have the right to request that we delete Personal Information we have collected about you, subject to certain exceptions.
- Right to Correct: You have the right to request that we correct inaccurate Personal Information we hold about you.
- Right to Opt-Out of Sale or Sharing: You have the right to opt out of the sale of your Personal Information or its sharing for cross-context behavioral advertising. We do not sell Personal Information and we do not share it for cross-context behavioral advertising purposes.
- Right to Limit Use of Sensitive Personal Information: You have the right to limit how we use or disclose sensitive Personal Information. We do not collect or use sensitive Personal Information beyond the narrow purposes permitted by the CPRA.
- Right to Non-Discrimination: We will not discriminate against you — including by denying services, charging different prices, or providing a degraded experience — for exercising any of your CCPA/CPRA rights.

Other U.S. State Residents
Depending on where you live, you may have similar rights under state data protection laws in Colorado, Virginia, Connecticut, Texas, and other jurisdictions. Subject to applicable law and certain exceptions, these may include the right to access, correct, delete, or obtain a portable copy of your Personal Information, and the right to opt out of certain processing. How to exercise your rights
You can request to exercise applicable privacy rights by contacting us at help@prxmusic.com. We may need to verify your identity before acting on your request, which can include matching information you provide with information we maintain about you. We will respond within the timeframe required by applicable law.
If we deny a request and you believe this was in error, you may have the right to appeal by replying to our response email or contacting us again with "Privacy Appeal" in the subject line.
Demo submissions
If you submit a demo through our Demo Submission form, you provide us with: your Artist Name, email address, a link to your track, and a short description.
- This information is used solely for internal A&R evaluation by the Proximity team.
- We do not claim ownership of any submitted track or creative work. Submission of a demo does not transfer any intellectual property rights to Proximity LLC.
- We will not share your submitted demo or personal details with third parties without your consent, except as required by law.
- We may retain submission information in our internal records for a reasonable period for reference and follow-up purposes.
- Submission of a demo does not create any contractual obligation on the part of Proximity LLC to respond, sign, or otherwise engage with the submitting artist.
Email marketing
If you submit your email address through our Demo Submission form or any future mailing list signup:
- We may occasionally send you updates about Proximity, our releases, or other relevant news — but only if you have indicated interest or consented to such communications.
- We do not automatically add demo submitters to a marketing list. Any marketing use of a demo submission email address will be based on a clear opt-in or a reasonable expectation established at the time of submission.
- You may unsubscribe from any marketing or newsletter emails at any time by clicking the unsubscribe link in the email or by contacting us at samantha@prxmusic.com.
- Unsubscribing from marketing emails does not affect our ability to contact you in direct response to a demo you submitted.
How we store and protect information
The Services are operated from the United States. Personal Information we collect may be stored and processed in the United States or in other countries where we or our service providers operate.
We take commercially reasonable technical and organizational measures to protect Personal Information, including secure hosting and access controls. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
We retain Personal Information for as long as reasonably necessary to provide the Services, respond to your requests, and comply with legal obligations. When Personal Information is no longer needed, we will delete or de-identify it, or securely store it until deletion is possible.
International users & GDPR
If you access the Services from outside the United States — including from the European Economic Area (EEA), the United Kingdom, or Switzerland — please be aware that your information may be transferred to, stored, and processed in the United States, whose data protection laws may differ from those in your country of residence.
Where required by applicable law (including the EU General Data Protection Regulation, "GDPR"), we rely on the following legal bases to process your Personal Information:
- Consent: Where you have freely given specific, informed consent — for example, by signing up for a mailing list or submitting a demo.
- Legitimate Interests: Where processing is necessary for our legitimate business interests — such as operating the website, responding to inquiries, and maintaining internal A&R records — and those interests are not overridden by your rights and interests.
- Legal Obligation: Where processing is necessary to comply with a legal obligation.
If you are located in the EEA or UK, you may have additional rights including the right to object to processing based on legitimate interests, the right to data portability, and the right to lodge a complaint with your local supervisory authority. Third-party links and content
The Services may contain links to third-party websites, services, or content (including music platforms, social media, and streaming services) that we do not control. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party sites or services you visit.
Children's privacy
The Services are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13.
If we learn that we have collected Personal Information from a child under 13, we will take reasonable steps to delete it promptly.
Changes to this Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will change the "Last Updated" date at the top and, where required by law, provide additional notice. We encourage you to review this page periodically to stay informed about our privacy practices.
